ARNOLD F. SOCK, Attorney At Law Opines On: Former Department of Justice Attorney Says ConvergEx Counsel Helped Prosecute Executive
A former U.S. Department of Justice prosecutor testified in New Jersey federal court on Monday that outside counsel for brokerage firm ConvergEx Group LLC helped prosecute a former executive, as a judge mulls whether that assistance made the BigLaw attorneys part of the prosecution team (U.S. District Court for New Jersey USA v. BLUMBERG et al 2:14-cr-00458).
Former ConvergEx executive Anthony Blumberg was charged with taking undisclosed profits on certain trades in 2014, and argues that the company's cooperation with the Department of Justice in the years leading up to his indictment essentially turned the lawyers into prosecutors.
It is interesting to try and understand the dynamics and the laws governing such situations.
